Hi can you please advise My husband recently had a reassessment for his Pip. The lady who came to see him said his mobility part would increase to higher rate. We have had letter from DWP saying he has been awarded the lower rate as he is 67 and cannot pay higher rate as he is over 65 as this is what law states. .As this was a review they requested to see he was receiving correct amount as his 3 year award would end in November is this correct. Has anyone else come across this.
I'm afraid, once a claimant reaches 65 the PIP legislation prevents an award of Mobility if one is not already in payment or an increase in the award if the claimant does not already have the Enhanced rate.
It is not an appealable Decision.
