Disability severe premium paid in with my ESA was created by Ollie
Advise wanted please!!
My son uses my address as always has done
He sofa surf around with his many friends
At the moment he is in USA and comes back sometimes.
Had a telephone interview with a compliance officer over another matter which had no basis at all.
He then ask me if my son lives with me, then I should not be getting the severe disability premium.
He didn’t seem to take on board that I said my son comes home and helps me when he does, but he’s not there !!
I’m left very stressed because I feel I’m now going to hear from DWP re this.
All my son does is use my address for mail
Comes home as and when
So I live alone!

Nothing on this board constitutes legal advice - always consult a professional about specific problems

This will be difficult as your address is your son's stated place of residence, it would be a lot easier if it wasn't.
Basically you are not entitled to SDP when he is at home with you but you may be able to argue that you are when he is not.
Have you previously notified the DWP when he is at home as this will strengthen your argument? If you haven't then it definitely weakens it.

Thanks Gordon
Thing is it’s been like this since he was 19
I was getting child tax credit as he was in education.
Then he went everywhere and has come home, my home on occasions and has helped me as a carer. But I have other friends do that mainly and stay over sometimes.
My son has not had his own place for all that time, he is now 25
And I doubt he may not come back from his travels permanently, if he does he won’t be with me and uses my address until such time as he has his own permanent place.
I don’t want to call them myself as no point I get too stressed. I’ve actually not done ought wrong,
Shall I wait to see if I hear?
Thanks Caz
