Hi all

I have a few questions regarding UC. A family member and his partner have had to make a new claim for UC as they moved to a new property and had to make a change of circumstances. The claim process itself was relatively straightforward.

When he attended his Biographical interview today (he has limited ID), the staff member at the Jobcentre asked him to provide a Fit Note. This is despite his ‘legacy’ claim being for ESA, where he was awarded ESA WRAG in October 2017, and the award has no official end date (which is surprising in itself).

My query is: if someone has been awarded a legacy benefit like ESA, and the end date isn’t anytime soon, why would The Jobcentre be requesting a new Fit Note? Surely there is something in legislation that protects people who are migrating from a legacy benefit to UC?

Poor training and failure to understand the new system. :(

They should not need a Fit Note as their existing claim should have been migrated to UC, however, it might be easier in the short term if they provide one.

However, I would still challenge the requirement of them to provide one as there is a danger that they will initiate a reassessment of their "ESA". award, which seems to be a common problem on transfer.
