Can anyone tell me why when you've stopped getting disability premium and someone gets carers for you, when that person gets state pension carers stops but you don't get disability premium back. I know it's considered overlapping benefit but your disability needs haven't changed.

So the payment of the Severe Disability Premium is dependant on no one actually receiving Carers Allowance against your DLA or PIP. If the carer starts to receive the State Pension then they should cease to receive payment of the CA, although they retain an underlying entitlement and may still receive the Carers Premium, this being the case then it should be possible for the caree to receive the SDP but they will have to contact the DWP office dealing with their ESA, IS or JSA claim to arrange for this to happen.
