You/they need to contact the DWP again, as I understand it, this was a DLA to PIP transfer. Now that the failure to attend Decision has been overturned the DWP should put the DLA back into payment until a Decision on the PIP claim is made.

Thank you so much for this advice.
Yes, this was a DLA to PIP transfer, I think that’s why the judge was horrified that this was allowed to happen. I will escalate this again to the case manager and hopefully they will back down. I know we are not the only ones affected but this have been stopped at the mandatory reconsideration with the evidence that we produced.
I can’t thank you enough for how quick you have responded, I am 100% sure this will make a big difference.

Sorry to hear you've had such a fight to be believed. (Sadly I'm not surprised.) Well done for not giving in! Hopefully the DLA & car will be reinstated promptly. Have you approached CAB or the MS society for help & support dealing with DWP?
As Helen's condition has deteriorated since you sent the PIP form in, is it possible for you to start collecting additional medical evidence & complete the diary from the PIP guide to send off as soon as the new appointment arrives? I do hope you'll be left in peace on reinstated DLA/car to allow you to recover a bit. You may have a fight to get enhanced mobility as its much harder than Higher rate DLA : Gordon is the fount of all knowledge!

Dear James, sorry I forgot to say(bit ill & all that), once PIP appointment for home visit arrives apply to have this recorded . You'll need 2 old fashioned tape recorders (Argos). Test first, you might need external mikes. New 90 min tapes unwrapped. Phone Capita on landline to confirm you are at home at the time & use iphone to photo & date room.

I can’t thank you enough for the advice and the link to disability rights uk.
I called the DWP again, and I asked for the case to be escalated to a case manager, who should look at reinstating the DLA. They wanted to know why, and I read out the statement, which I received through legal advice. The case was escalated when I was on phone, which is the first positive response we’ve had from them. I know I it’s not legal advice, but it’s better than that, as far as I am concerned.
I have managed to get mobility to extend the lease by 2 weeks because I was finally getting somewhere. There is still a long way to go but we finally moving in the right direction thanks to thmyour advice.

I will call 30 minutes before the appointment and then every 15mins until they turn up. I want to video the assessment as well as recording the assessment on a tape recorder.
I want to make sure they put the DLA back in to payment, so that Motability get the back pay as well as Helen. The DWP want to send it back to Capita because they will only payback the lost benefits if Helen gets enough points.
I am going to see what happens this week because the DWP could change their mind and refuse to put the DLA back into payment. If this happens then I will ask for legal help from the MS society and Citizens advice. I will let you know how we get on.
