question 9 ESA form different. Is this new? was created by sam1982
Hi wondering if anyone can help.
Ive had an ESA renewal form through. I am currently in the support group for ESA.
Im a bit confused as the ESA form appears to be different than the one i completed last time (about a year ago) and it also appears different to ESA member guide on this website.
Ive had a read through the ESA member guides and just wanted to clarify something:
on my recent ESA renewal form on question 9 it asks:
9. Controlling your bowels and bladder and using a collecting device
Do you have to wash or change your clothes because of difficulty controlling your bladder, bowels or collecting device?
then it gives options of yes- weekly, monthly, less than monthly and only if i cannot reach a toilet quickly.
however the ESA member guide on this website says for question 9:
9. Absence or loss of control whilst conscious leading to extensive evacuation of the
bowel and/or bladder, other than enuresis (bed
-wetting), despite the wearing or use of
any aids or adaptations which are normally, or could reasonably be, worn or used
The part that seems to be missing in the new ESA renewal form is the 'whilst conscious' part. The member guide on this website includes it but my ESA renewal form doesnt use this phrase at all.
Its a critical thing for me as i suffer epilepsy and loss of bladder and bowels on average 4/5 times per month.
However i know the DWP would still class me as being conscious despite me fitting and being totally out of it. Not having the phrase 'whilst conscious' included on question 9 of the form means i would answer yes weekly and hopefully score some points.
Has the ESA renewal form changed? as its is now not showing 'whilst conscious' in this question? Surely they would need to include the 'whilst conscious' part on the question form as it does make a difference to people whether they are conscious or not.
grateful for any advice.
thanks

Nothing on this board constitutes legal advice - always consult a professional about specific problems

Cleocat
You are comparing the question on the form to the legal definition of the Descriptor. The form contains simple explanations of the ESA Descriptors but it is the latter that you are being assessed against, not what is written on the form.
If you scroll down to the bottom of page 61 of the ESA Claim guide you will find the question from the form listed.
