ESA 3 Year Review Due Soon was created by bmeenan
Hi
We are starting to prepare for my wife's next ESA form, she is currently in the Support Group and has been for three years now.
I realise that every claim is a "new" claim and that everything has to be detailed in the form, but can any reference be made to being in receipt of an existing award? If so, is there any particular guidance where this should be detailed and in what sort of detail? Do you think it would help give the Assessor a clearer picture of my wife's "history"?
Thank you for your time

Nothing on this board constitutes legal advice - always consult a professional about specific problems

There's no problem with you mentioning a previous award but don't rely on it to help with this assessment, as an example; someone with Progressive MS would be able to rely on their current award as their condition can only worsen, however, someone with mental health issues could not as the DWP will take the view that there is a possibility of their conditions improving.
Also, if she qualified through the Significant Risk Regulations then you cannot rely on the previous award at all and must provide up to date evidence to support the claim.
Make sure you use the latest ESA Claim guides, although the Descriptors have not changed in the last three years, the DWP guidance has been updated several times.
