My son has recently been refused ESA despite being on and off it for a number of years. We are going for a MR but have applied for UC in the mean time. At the job centre today they told me we needed to get a fit note from the doctor if we expect them to look at his special needs whilst claiming UC. However when I phoned the doctors they said they had had a letter from the DWP advising them not to issue any fit notes. We now have a face to face appointment with the doctor on Thursday but how do I persuade the doctor that he does not ave to follow the DWP letter and refuse a fit note when my son as clear disabilities?

In case you are not aware, your real name appears to be showing in the forum, if you want to change this then follow the instructions in the following FAQ
My full name is showing, how can I stop it?
The letter should only refer to ESA and Universal Credit. It may also make reference to appealing and it being acceptable to issue Notes in this situation but I am aware that there is a new version of the letter that does not include this. Lastly, I believe that the letter says that they do not have to, it does not say that they must not.
