Hi,

I was just looking for a bit of advice please, I won my Tribunal for PIP just this year back in February and both myself and the Welfare Rights adviser thought as I was awarded until October 2019, then I would most likely be reviewed around October this year, the usual one year before your end date. After several phone calls to PIP to try and find out when I should be receiving the review form, I was eventually advised that I won't be getting reviewed until 14 weeks before my award end date, which would be around June/July 2019.
They said they sent a letter out confirming this, which is true I just hadn't read it properly, and the adviser did say that they usually do the one year before reviews, but as I had just won my Tribunal this year then it would be too soon to review hence the shorter 14 weeks before review. Have you heard of this happening? Is it a new thing? I am a bit sceptical and even though it's down in black and white, I am still dreading the old brown envelope through the letter box situation lol :(

Yes, they do this for claims where there is less than two years on the award. Rather than the AR1 Review form, you will need to make a new claim for PIP, the DWP should contact you 14 weeks before the end of your award but I would actually start the process at least a couple of weeks before this so that a Decision can be made before your existing award ends.

Ok, yes that makes sense, actually could I ask just another quick wee question please, I was all prepared to complete the review form as of now as I thought it was coming, my care needs have changed and I have together a support letter from my social worker and some medical documents to back up these changes, should I send in a letter to report a change along with this evidence the now? Or is it best to leave this till next year? sorry I am bit scared to rock the boat as I have already been through two tribunals, can't face another so soon :(

I can't tell you that shouldn't report a change in your conditions but the DWP are not usually bothered if there has been a deterioration. One thing to check is whether you would actually qualify for a higher award because reporting a change when would not qualify for one is not to your advantage.

Sorry to hijack Layla's post here, but I was just reading this as I feel it might be somewhat relevant to my own PIP claim. Gordon, does what you have said mean that if you have been awarded PIP for less than two years, that you have to make a new, fresh claim for it once that award is due to end, instead of having a review; and if a decision on this new claim isn't made before the previous one ends, then you will be left without any payments until a decision is made on the new claim? And if so. how will this affect other benefits, i.e. disability premiums on ESA, exemption from shared room rate of LHA if under 35, and so on?

Yes, I do mean that and if there is a break in payments then any passported benefits would be affected, however, I would expect any new award to apply from the day after the current PIP award ends so any lost payments should be recoverable.,
