2nd MR ? was created by Peter
I had an award after an MR.....1 point away from enhanced on daily living & I was awarded standard mobility. The mobility aspect is fine. I was very puzzled by the daily livinmg award...I got 2 points for prompting on dressing, washing, mixing with people, preparing a meal & 2 points for complex budgetary decisions plus the useless 1 point for medicines. I go no points at all for toileting, despite the medical evidence I supplied from my psychiatrst & psychotherapist covering all aspects. It seems for some reason this aspect which was just as strong as the others was ignored. It really is baffeling.
I do not wish to appeal as the possibility of losing this howewer slight would un nerve me so much. Can I just write to the DWP pointing these anomolies out in the hope they may see the error of their ways as it were and give me 2 extra points ?? Or is this not on at all ??
Many thanks
Peter

Nothing on this board constitutes legal advice - always consult a professional about specific problems

The risk to your award was in requesting the MR, a Tribunal panel has to warn the claimant if they feel that an existing award is at risk if the appeal is continued with, so that it can be withdrawn, the DWP have no such duty.
Unless you have something very new that you can present then there is no value in writing to the DWP, they can only look at the Decision under an MR and they are not going to do a second one, if at all, without there being something that they have not seen before.

Peter can i just add something which might help- do you have therapy to follow at home? as that would add another point to the useless one.
