My brother had a traumatic brain injury when he was five this has left him with problems all his life! He came off a motor bike and now has one leg (right) two inches shorter than the other he has also had a mini stroke and a couple of Tia`s . He also has an irregular heart beat had 2 Cardio-inversions and is now on warfarin for life he also has type 2 diabetes.
He has had several falls missing kerbs etc he had a shoulder operation due to one fall. His strokes and brain injury have left him with short term memory problems and sight problems.he also since 2014 has been suffering with anxiety and depression. He has been awarded no points for PIP we have done a mandatory appeal and it came back to him within a week saying decision not changed ! We have supplied medical evidence re all of his problems record of his accident at 5 year old is recorded on his paper work from the doctors.
The HP from ATOS said he had put a clean shirt and pants on that day how does she know that? Also he gave good eye contact and he walked upstairs and did not use the stair lift he walked up 2 steps to get to the stair lift! She also did an eye sight test from 5 feet away and said his eyesight is ok.. He has 3 problems with his eyes due to the stroke/brain injury. They are saying he can cook a meal in a microwave she was told he can only warm thing up the list goes on and cannot list everything down and I am at my wits end as how to do the appeal.?

Don't get hung up on the assessment report it is not always the issue that it appears to be, see the following

Your strategy for an appeal is to first make sure that you have shown that your brother meets the criteria for an award, he needs to complete the activities reliably and on the majority of days.
As a secondary activity, deal with the issues that are in the report but do so by reference to your evidence and try to stick to issues of fact, it's better to undermine the assessor's opinions by showing that the information on which it is based is incorrect than arguing directly against them.
