The Decision includes the length of the award so it can be changed by the Tribunal panel but you will need to make a case for a longer award, it will not be a given just because you have x, y and z conditions.

Hello All,

I was wondering if you could tell me what happens if the DWP miss deadlines for tribunals? I ask because I sent in my application for a tribunal hearing, and last week I got a text from the tribunals service, stating that the DWP should have responded by April 16th, but they hadn’t. I guess they will just get more time....even though I doubt they would give me extra time if I hadn’t stuck to the deadlines?

The Judge responsible for your appeal will issue a warning, nobody here has reported getting to a hearing without the DWP making a submission but I have seen it on another forum.

Hello Gordon and all,

So, now the DWP have managed to send their stuff over to the Tribunal Service. I have also sent more evidence. I am now making myself sick with worry, and I wonder if I might ask does anyone ever get to this stage and then NOT have to attend the tribunal?

I have also discovered that all through the report, the HP states my medication has been the same for years....even though I clearly told her and gave her a prescription showing that two of my meds have been doubled and an extra one has been added. I’ve pointed this out to the tribunal.....would that alone be enough to prove the HP was incompetent?

Decisions do get revised by the DWP before the hearing but you cannot rely on this happening and it won't unless you provide more information for your appeal.

It's worth your mentioning the discrepancy on the medication but I doubt that it will be sufficient to prove the report is not fit for purpose and even if it did this will not result in an award, the panel will be much more interested in understanding how you meet the PIP Criteria.
