My PIP award was up until Nov 2019. After a recent assessment all points have been stripped to Zero. I had a lot more evidence , diagnosis's and reports. Unfortunately due to my MH I let a Welfare Rights person fill in my form and never read through it. When I did before my assessment I was gutted that it was more or less filled in with no change from my previous award, which I suppose is mainly true except I have different symptoms but they affect me similarly. Anyway I wonder if I should seek help to go down the Mandatory Consideration / appeal route or put in a fresh claim? I was only awarded standard rate care despite being told I should have got more and should have appealed that. But could not take any more stress at the time.

Sorry to hear this.

The first stage to challenging a Decision is for you to request a Mandatory Reconsideration, this needs to be done in writing to the DWP, within one month of the Decision, to the office that dealt with your claim, have a look at our PIP MR & Appeal guide for details of the process, the PIP area also has template letters that you can use to make the request with.

You should contact the DWP for a copy of the assessment report if you have not already done so, I would phone them but again follow up the request in writing. Once you have the assessment report you will have a better understanding of how the DWP Decision Maker has come to their conclusions and will then be able to argue against them.

Your primary task is to show that you meet the criteria, there are many reasons you may have failed, you need to address each of these but don't get bogged down in criticising the assessment report unless you can clearly show that it is incorrect, it is a lot easier to argue the facts of the situation;

"the assessor recorded that I walked 50m, I did but they have failed to document that I had to stop every 10m for a rest due to breathlessness"

than their opinions

"based on my observations of the claimant walking I believe that they can reliably walk more than 200m.

Hi Gordon, I have asked for a copy of the assessment report. And will wait until it comes in and see whats, what. Going to zero points I can imagine. As I said my forms were filled in by a third party both times who from reading what the wrote have never fully understood my conditions. That is why I wonder if I should Appeal or Reapply using the guides on here??. One of my conditions Long QT Syndrome stops me or limits me getting medication for my other issues and that seems to be one of the problems that nobody understand.
