CHECKING "ESA backdated" assessment from DWP ? was created by ainesse
Having searched all over this forum I can not seem to find anything relevant so I decided to start a new 'topic'. I spent an entire week and more working on an ESA3 (IBR) 06/18 form which the DWP sent to me a couple of months ago. Once I had gotten over the 'trauma' of receiving anything like this from the DWP....I sat and thought about it.
Although half of me was thinking OMG "oh I don't know if I can bear going through another one of these 'exercises'`' at the same time I reckoned that YES I might well be entitled to some additional payments during the years they wanted information from me which was late 2013 - present day.
Anyway so I worked on getting all the information together and in the end, it was a considerable pile of papers that was in the envelope that I sent back to them. My partner was instructed to be sure and get a "proof of postage" from the Post Office. It was posted off on 25 February.
To my surprise I received a reply from them dated 7 March saying that I was not entitled to anything.
After only a one-week turn-around!
The letter says
"we have reviewed your benefit and having looked at the information you gave us, you are not entitled to ESA(IR) from 15 Nov 2013 to 13 Nov 2014.
Why you are not due ESA(IR)
The contributions based ESA that you have already received exceeds the amount payable on ESA(IR). We have included a copy of the assessment panels to show how the decision was made.
The attachment was one sheet A4 sheet with size 6 or smaller font text - typed on one side of the sheet which is 'incomprehensible'. I wish I could attach it, so that you or someone else might be able to try to understand it.
I had thought that from Nov 2013 to Sep 2016 I might be entitled to an additional approx £50 per week. During this time I was only receiving 50 odd pounds a week.
Having had a horrible experience previously with the DWP (applied for PIP and was awarded "zero" THEN joined up here and got CAB involved and spent a year waiting to go to tribunal)
which was successful
.....I dont trust them or have any confidence in them.
I mean -given their actual statement - "Why you are not due ESA(IR)
The contributions based ESA that you have already received exceeds the amount payable on ESA (IR "). which does not seem to have any relation to the information that I actually spent all that time preparing to send to them. I have to say I went to a lot of trouble to prepare the information ~I sent to them by identifying and labelling items a, b, c, d etc etc. and organising them in the order to be read.
Can't say the same for them. What I am now wondering is
Have they just thought to shove this excuse to me to "put me off" thereby not needing to bother sending it to the separate department that properly assess these 'backdated claims.
As I said above I was only receiving 50 odd pounds a week and if they knew that already from having access to my case notes on my computer then why on earth did they sent me the form.
It doesn't make sense.

The form is being sent to everyone who was transferred from IB to ESA whether they meet the criteria for a payment or not.
You mention that your ESA(CB) is reduced, is that due to a pension? If it is then I would estimate that it must be around £200/week which would far exceed any ESA(IR) that might be payable.
