appeal outcome im confused was created by frances
Hi, I recently had an appeal decision allowed it says I have 18 points original was 0, and that I have LCW, then on the other side of the letter it says, by reason of multiple health conditions I'm significantly limited.
My question is I have ongoing mental health problems, have I been placed in WRAG ? I did these interviews 4 years ago before I was placed in SG, will I have to face those again? Thanks

Nothing on this board constitutes legal advice - always consult a professional about specific problems

Limited Capability for Work and the 18 points you scored placed you in the WRAG.
It usually takes the DWP 5-8 weeks to process a Tribunal Decision, I would contact them to make sure that they have received the Decision Notice.
I can't say if you will be required to carry out Work Related Activity and if you are, what that might consist of, if you are contacted then make sure that you explain your conditions and limitations to the advisor, they will not have access to this information.
If your conditions have deteriorated since the date of the Decision you appealed and you can show that you now meet one of the SG Descriptors then you can ask to be reassessed, this will mean a new ESA50 and almost certainly a face to face assessment.

Thank you, Gordon,
I'm at a low ebb and I can't face another assessment, the last Advisor I had at the job centre was nasty, explaining mental health and physical health conditions to him in an open office was degrading, or at least this was how he made me feel, his best comment by far "If you're too lazy to fill out a GL24 and write a supersession letter, I'm going to refer you to another office, (little Hitler) which he did, and it was 30 miles away. Having Osteoarthritis and wrist ganglions make it painful to write and type. The next Adviser was helpful and got the CAB involved, but she has long since left SEETEC.
Thanks for the Advise I will contact the DWP and see if they have the Tribunal decision form. The Tribunal Panel told me I wouldn't have to do anything.
I shall re-subscribe as I always get very good info from all on here, even if I can't use the site to its full potential.
Thank you once again
