Having gone through the Mandatory Reconcideration, I have appealed and am waiting for a tribunal date. The DWP responded to my Appeal and a copy was sent to me.
The bit that got my goat was the section on "Reasons For Preferred Evidence". They chose to take what the health professional (HP) said over what I said - except where it could be blown up out of context to take points away.
There is always a game to play with the DWP. The game here is to get as much evidence as you can from outside professionals. Personally, I should have paid to see a physiotherapist rather than let them rely on the tosh the HP cut and pasted from the Atos training manual. I should also have paid to see an OT to get them to prescribe the wheelchair I have relied on for the last 56 years.
I have been in and out of wheelchairs since I was 10. I am now 69. I don't bother my GP because there is nothing he can do for me so there is no evidence he can add.
I have regular reports from my hospital consultant but they "Do Not Count" as they confirm my diagnosis but don't describe my limitations.
I was first issued a wheelchair in 1963. Over the years I have bought my own wheelchairs as they are much lighter than the NHS ones - so I have no formal assessments to fall back on.
