More evidence after MR was created by Froblymobly
Hello I had my MR, I informed them I was due to see a physiotherapist and due to see a pain specialist at the hospital. Before my appointments however the MR came back. Nil points for managing therapy but I have since been advised to carry out gentle physio at home. Also I have been referred by tbe hospital for psychological therapy . In the MR application i wrote that i was having difficulty managing mentally but they said I did not seem anxious at the MA day.
Can I send in my evidence as a retrospective additional support. Is it possible to request only particular sections be looked at ie Managing therapy and descriptors which I originally explained due to physchological distress. If not, can I request the tribunal look only at the daily living part of my claim or will they have to look at the whole claim?
Thank you

Nothing on this board constitutes legal advice - always consult a professional about specific problems

If you have had a Decision on your MR then the next stage is for you to request an appeal.
The PIP Appeal guide has links to the SSCS1 form that you will need to complete and the Submissions guide has a complete example that you can use to help you fill it in, you do not need to provide detailed reasons at this stage for your request.
Once your appeal is accepted the DWP will prepare their submission to the hearing and send you a copy, whilst you should wait until you receive this to finish and submit your own, you should start to prepare your own case, an increased award will only be made by your showing that you score the extra points for one, so I would start by going back through your PIP2, the assessment report and the PIP Claim guide to see how you might show this is the case.
I would send the information about the pain specialist and the physio but it is likely that it will be ignored as it post-dates the Decision.
You can ask the Tribunal to only look at a particular thing but they do have a duty to ensure that the award is correct but if this would result in you potentially losing points then the Judge in charge of your hearing must warn you of this and offer you an opportunity to withdraw your appeal.
