Hi,
I've got a question about the timeframe on a PIP mandatory reconsideration/ appeal and wondered if someone could help.
I was awarded Enhanced Daily Living for PIP for my mental health - the assessment was carried out at home with my mental health nurse present. In the assessment, I was really distressed at one of the questions about planning a journey and both me and my CPN believed I would or should be entitled to standard mobility under the 'overwhelming psychological distress' grounds.
My assessment was carried out on 31st May 2018 and I believe I received my decision in June or July 2018. Multiple things have happened during that time that took priority over appealing & myself and my nurse knew we'd get round to it eventually and that she could vouch for why I hadn't been able to appeal sooner (I was going through an assessment process for an autism diagnosis, was admitted to hospital following an overdose, had an incident with an NHS team that required a formal complaint etc).
The problem I have now is that in January my nurse went on long term sick and now she's not returning so I've got to do the appeal with a friend's help rather than my nurse. My friend can't back up the things that the assessor left out of the report etc so I'm worried about that but I'm also worried about the timescale for asking for MR/ appeal.
For some reason I seem to think I'd have until 31st May, the date the assessment took place? I'd appreciate any advice about this if someone can either confirm this or put me right?

The maximum period for making a Late request for an MR is 13 months from the date of the Decision you want to challenge.
Your request will need to explain why it is so late. The DWP do not have to accept your reasons but if they don't you can still go on to request an appeal within one month of the date that the DWP decide on your MR.
