As you will be aware, I have posted quite a number of issues on this forum and I hope I am okay in posting a further one?
May I ask if you have any templates on how to set out a paper based hearing for the Tribunal Services? I do realize that the statistics show a greater number of cases are actually won via oral hearings, but there is a very unfortunate flip side to attending. I am led to believe that Tribunals have become increasingly hostile and the panels just seem hell-bent on trying to show a claimant has a poor memory of certain events, and so in their eyes, he/she is an unreliable witness. As someone who has said to a number of people I see at my Support Group that I am willing to help them as I can with their hearings, it has to be said that the thought of not having to go into the Lion's den is extremely comforting, and it is actually preferable for the 2 people I am trying to help. Hence, I was just hoping you might have some kind of structured template to follow. I understand there can be well over 100 pages of papers to go through, so just where would someone start? It is surely impossible to try to memorise every single page, so there has to be a way of compiling something suitable that could include relevant caselaw where and when appropriate. I am also aware of the excellent guide on here to looking at the HCP assessment findings. It would be great to actually know how to structure that as well, in a way that will get the whole case across, but also without the disadvantage of someone being made to feel as if they have been dragged across a field by the panel. I know that you provide enough information to structure a template, but unfortunately I am just not up to the where's and why's of such a tool. Any advice and information is genuinely appreciated. Writing a submission for a Paper hearing is not significantly different from one that you might produce for an Oral hearing. There's a template example in the MR & Submissions document in both the ESA and PIP sections.
Be aware you will only have one month from the date on the DWP's submission for the Tribunal Service to receive yours.
