The DWP/OC called if they could use old DLA info was created by Flopot
Hello,
FYI -- I am referring to the Department of Communities in Northern Ireland
We recently completed the PIP process for an autistic family member. He did not receive enough points to receive payments for his daily living activities. However the reason I am posting on the forums is ask about a strange call this person received during the process.
After the assessment we posted additional medical evidence to the Department to bolster his case (e.g. old educational reports about his autism diagnosis) because the Assessment interviewer kept asking for proof from his school years. Anyway a week or too later the Appointee of the autistic family member got a call from the Department. The caller asked if they could use the autistic person's old DLA information as part of the evidence. His mother said yes as she thought the Department would try to help Robert's case.
Subsequently, given the very few points the claimant have now received, we now think we were naive in giving the Department such permission. In fact we suspect it was quite nefarious of the Department to call like that, given that it probably undermined the autistic person's case.
So, finally, our question is as follows -- should we call the Department and take back permission to use the claimants old DLA evidence, as part of our Mandatory Reconsideration appeal?
kind regards
F.

Has the appointee requested a copy of the assessment report? This will give them an idea of why the claimant has failed.
They can't withdraw permission for the DWP to use the DLA information, if it has information relevant to the PIP claim then the DWP are entitled to use it. It may have nothing to do with the reasons that the claim failed.
