DLA to PIP Additional Evidence was created by willow
Hi Gordon
My wife is currently being transferred from DLA to PIP - We submitted the PIP2 Form on 05 May 19.
We have received a form PIP.0221 from the DWP dated 15 May 19 Informing us that the evidence from our DLA claim cannot be found and would we like to forward any further evidence by 16 June 19.
We have begun to obtain full medical records -
We have now received a letter from Independent Assessment Services requiring us to attend an assessment on 30 May 19.
The DWP have advised me to comply with the IAS request - The IAS have rescheduled the assessment to 15 June 19.
Is there any breach of regulations here?
Can the IAS override a DWP deadline to obtain additional information like this? - I am considering making an official complaint.
Please advise
Thanks

Nothing on this board constitutes legal advice - always consult a professional about specific problems

You are assuming that IAS knew about the DLA deadline, they probably did not as the letter about the missing DLA information was probably issued after your file had been sent to IAS for review,
You say that the appointment has been moved back to 15 June, it would be worth your checking that this has been done at no fault to you as you only have two opportunities to attend an assessment.

Hi Gordon
I recontacted the DWP, normally the waiting time for assessments is about eight weeks, so the deadline for submitting additional information is not an issue. They had never known an assessment to to be arranged so quickly.
They have left a note on my file, if there was a valid reason for us being unable to attend the assessmen, then we must inform the DWP in the week following the assessment date, IAS take about a week to inform the DWP of non attendance.
Many Thanks
Paul

Please be careful about this, the call centre staff have no authority in regard to assessments and what you have been told is just what the DWP would expect a claimant to do anyway.
