DLA when over 65 trans to PIP was created by minty3825
My husband was told that his DLA that he had been receiving since 2006 was now a lifetime award as he had turned 65 in March 2018. Today he received a letter telling him that his DLA is ending and that he has to apply for PIP. My question is can he get PIP as he over 65 and as we receive Pension Credit will this be effected as I am only 63. Pension Credit wrote to us earlier in the year and said the system had changed and that both parties of a couple now have to be at pension age to claim Pension Credit but as we had an existing claim we would not be affected, but if we had a circumstance change my husband wouldn’t be able to claim for me. Will we be affected for Pension Credit.

The legislation that controls the transfer for DLA claimants to PIP suspends the limitation on making a claim for PIP over the age of 65 so yes, he can receive a PIP award.

Your PC award will not be affected by the transfer unless the award is dependant on his current DLA award in which case it would likely be dependant on his receiving an award of PIP.
