Hello
A friend has received a compliance letter she is in receipt to HB,ESA (SG) and PIP. She is living with a friend who she has not declared and is wondering what the potential consequences might be for her. Will she have to provide her friends name at the interview and if he is living at a friends place(he will be leaving soon) how will she prove this?

Your friend could potentially be committing benefit fraud depending how long their friend has been staying with her. It would depend on how long they had been staying and when they intended to return to their own accommodation. If she was accused of benefit fraud then it would be in her interest to give her friends details to show that they had their own accommodation.
Most people get found out about co-habitation via their social media accounts or via a credit reference agency.
As HB is means tested, could potentially be committing benefit fraud.
If ESA is contribution based, this is not means tested so no problem, if it is income related then could potentially this could also be benefit fraud.
As PIP is not means tested no problems.
If your friend is being interviewed under caution then they are looking at benefit fraud and your friend may want to see seek advice from either Citizen Advice or a Solicitor before attending the interview.
If she is found guilty then she could be sactioned, receive a penalty fine and an over payment.
