hi everyone is it possible to go from income based ESA support group back to contributory based ESA support group the reason I say back to contributory based ESA is I was one of the people back in 2012 wrongly placed in contributory based ESA when I should have went into income based ESA this got sorted out eventually. the reason I am asking is my unpaid carer as I don't get carers allowance may have to stay with me full time as my condition has worsened and as he is in full time employment id imagine that would effect my benefit of ESA income based.. on the letter I get each April it says I am still in receipt of an element off contributory based ESA. I really hate phoning these people without a little prior knowledge many thanks in advance geo.

If your ESA claim was originally Contribution Based and it has been unbroken then it is still Contribution Baed, possibly with an Income Related ESA top up.

Your carer living with you can affect your ESA(IR) is a variety of ways but there are two obvious ones.

- If you are receiving the Severe Disability Premium, shown as "money because you are severely disabled" on any ESA Entitlement letter, then you would lose this as you are no longer living alone unless they also receive a qualifying benefit of DLA, PIP or AA.

- If the DWP treat you as a couple, which is a possibility, then their income, savings and any hours that they work will be taken into account.

yes only difference was I got the £16 disability premium. on change over to income related ESA. I also get low rate care and high rate mobility. DLA. we both have no savings could I ask to be moved back to contributory based ESA just now and wait to see if my carer has to move in with me. my carer will be in receipt of state pension and working full time if they move in all depends on my health issues.

You are already receiving ESA(CB) with an ESA(IR) top-up.

so if my carer moved in with me they would only take the £16 top up back?. As I am led to believe you can have a private pension and any amount of savings in the bank while on ESA contributory based.. is this one of the variety of ways it could affect my ESA payements? thanks for replys I have very little knowledge of this complicated system

Not necessarily, it will depend on how they view your Carer living with your, if they decide that they are not part of your household then there will be no impact on your ESA but we have seen similar circumstances where the claimants and the other person have been considered to be a couple, if this happens then the ESA(IR) might be affected.

ESA(CB) is not affected by savings but pension income can affect it.
