ESA stopped from support group was created by Cornwesar
My boyfriend was in the ir support group and was awarded 0 points after an assessment and has had esa stopped. He suffers from chronic alcoholism and depression which affects his ability to be able to work. The woman at the interview focussed on the fact that he sometimes uses the internet to say he can work, never mind his social anxiety and problems he has from day to day life, which was completely ignored during the assessment. My boyfriend said he was nervous and swaying due to nerves during the interview, and it was stated “no evidence of rocking” whatever that is supposed to mean!. So he is distraught, any help please would be grateful.

Hi Corn
Unfortunately your story is not unusual, the first thing you need to do is request a copy of the HC report, you then need to request a Mandatory Reconsideration (MR), remember time limits, one month from the decision letter date, you can do out of time requests but they are much harder.
In setting out a MR you need to list all the reasons as to why the HC was wrong and send in any additional medical evidence you may have. At this stage most people are still told that the decision maker has upheld the original decision, do not let this put you off. The next stage is then to appeal, sounds quite daunting but if you follow our guides it is quite straight forward, remember you have more chance of a success if you attend the appeals tribunal in person.
