would gp lettter help was created by nannym20
i have had my pip award lowered to standard mobility and care which means we will have to hand our mobility car back in .
i have been looking at claiming under mandatory reconsideration
when i had the review they did not ask for a GP report and i did not realise i needed to send one in
i have seen my GP today who has agreed to help me but we dont know if just a letter stating my disabilities and medical history would help at this stage or if i should ask for a more in depth medical report at this stage

Hi Nannym20

Welcome to the forum, you might want to have a look at the following FAQ which explains where everything is

Welcome to Benefits and Work

You did not have to send in GP's report and nor do the DWP automatically request one. They sometimes contact the GP if they do not think they have enough information.

The first stage to challenging a Decision is for you to request a Mandatory Reconsideration, this needs to be done in writing to the DWP, within one month of the Decision, to the office that dealt with your claim, have a look at our PIP MR & Appeal guide for details of the process, the PIP area also has template letters that you can use to make the request with.

www.benefitsandwork.co.uk/help-for-claimants/pip

You should contact the DWP for a copy of the assessment report if you have not already done so, I would phone them but again follow up the request in writing. Once you have the assessment report you will have a better understanding of how the DWP Decision Maker has come to their conclusions and will then be able to argue against them.

Your primary task is to show that you meet the criteria, there are many reasons you may have failed, you need to address each of these but don't get bogged down in criticising the assessment report unless you can clearly show that it is incorrect, it is a lot easier to argue the facts of the situation;

"the assessor recorded that I walked 50m, I did but they have failed to document that I had to stop every 10m for a rest due to breathlessness"

than their opinions

"based on my observations of the claimant walking I believe that they can reliably walk more than 200m.

When you have a better idea of the issues with your claim, come back to the forum and we will do our best to help.

And yes a more comprehensive letter from your GP would be helpful but read through the guide first so you know what you want them to write.

Hi Nannym20

It is up to you what you decide to challenge in your report, but as ignorant as it is for the assessor to say you 'look too well to be disabled' - getting a reviewer to agree with you won't increase the PIP award. So although you may wish to mention it, your greatest efforts should be directed at where you disagree with the points awarded for different criteria. If as you say you need help to do certain things and the assessor has said you don't, that is very easy to challenge by pointing out evidence you have already submitted or even new evidence. By the way, if your husband did not write a letter first time around, you could always include one from him, about what he does for you.

I'm in the same boat as you right now - my transfer from DLA has given me only standard for mobility and I'm gonna lose my car if I don't challenge it. But do talk to Motability as they have been wonderful so far and offer lots of help with these unfair decisions.

My assessor at the f2f also seems to have ignored the fact that my husband helps me with everything and in the mini report it seems like she omitted A LOT and insinuated things that simply weren't true. I know I need to challenge the facts but it's hard not to get emotional about the stuff they've said, when so much is wrong and it seems like they are calling you a liar.

I am requesting the full report and going to see my gp for help on Monday - it's a very overwhelming and daunting prospect/ process but they've designed it that way so many do not go through with challenging their decisions... Don't let them get away with it!!

Good luck with it all!!
xoxo
