Hi guys,
Just had my decision from the DLA (med care, high mobility indefinitely) to PIP result and whilst I was expecting to be disappointed I was not prepared for the lies stated by the f2f "professional" - I prepared well for the assessment by reading your guides, made sure I qualified everything and didn't give just yes/no answers yet she straight up lied about several very important things.
How do you deal with that when requesting MR? For example she wrote I had no trouble with concentration or cognition yet I was constantly stumbling over my words, asking her to repeat things, couldn't find the right words, had to refer to my written notes several times, had to have my husband read some of it as I was getting things muddled up and couldn't even work out where the car was parked.
Oh and she said I appear "well nourished" - not understanding that just cos I'm fat doesn't necessarily mean I'm not malnourished, plus I only eat because my husband does all the cooking because I can't do anything in the kitchen due to accidents and confusion yet only 2pts!
Oh and her "physical examination" was bloody joke!!

I could go on with her lies and ommissions but I don't want to bore you all.
Anyway how do you basically say the assessor was lying/omitting facts when you ask for a MR? Or when you go to tribunal?

Sorry for garbling (I edited this quite a bit cos I'm in a bit of a state and wrote about everything lol) but I'm really upset as I'm probably gonna lose my Motability car over this and it's my one lifeline to the world so I can leave the house once a week (I can't do anymore due to pain & depression)....

Sorry I'm gonna keep going if I don't sign off here...
Hope someone can advise :)
Thanks xoxo

First of all, it can be tempting to deal with everything in the report but you need to resist this and just deal with the issues that lead to your scoring points.

Separate facts from opinions. You can directly challenge facts that you believe are in error but you should be cautious of doing this with opinions, it is much better to undermine these by reference to your own testimony and if you can, your evidence.

Whilst an inaccurate report is almost certain to have played a part you also need to consider whether you have properly explained your problems in your claim form, is it possible that you have misunderstood the Descriptors, described your problems in terms that do not match the Descriptors or failed to make appropriate use of the reliability criteria or the need for your limitations to be present on the majority of days to be considered?

Thanks for the reply Gordon :)

Tbh I thought my form was good - but I don't know :/
All I know for sure is that from the report written on my letter there are references to things that are not true/did not happen/do not reflect what really happened in my interview and this very plainly had a significant impact on the decision.

The fact that I got standard care is annoying as I know I have more points owed to me on several topics but it's only getting standard mobility that I really need to challenge cos I can't afford to lose my car - should I challenge all points or just the most important ones?

Rn I really want to know how the assessors sleep at night knowing they are lying or omitting facts and potentially ruining people's lives.

I'm really overwhelmed rn as this all just happened today.

Oh and does everyone else getting their letters a week after the date of the letter? I know royal mail can be bad but this happens consistently with every piece of correspondence I get from DWP :(

The letters have to be approved and are then printed, enveloped and sent from Belfast so it not a surprise that it takes a week or more.
