PIP review - Q about change in law. was created by Estibeiro
Hi. One of those dreaded brown envelopes appeared in the post this morning. This one is a form for review of my PIP claim. I currently am in receipt of enhanced rate award for help with daily living needs but no award for mobility needs. This shifted from when I was on DLA and had lower rate for daily needs but did receive low rate for mobility. I didn't quibble it at the time as the effort wouldn't have been worth the possible reward should I have been successful and I didn't want to risk losing the enhanced award I'd gained.
On 10th December last year I received a letter saying that changes in the law had led to my claim being reviewed but that I still would not be awarded mobility allowance because (and I laughed and cried at this):
"you avoid overwhelming psychological distress by not undertaking any journey on the majority of days despite any assistance you could receive"
Ie, you are so distressed by going out that there's no point offering you any further help and no consideration was given as to whether regular support from someone would lead to my being able to go out. Especially that with some extra support I might manage some of those 'essential' visits I have postponed for years such as my cervical screen and mammogram.
So when I fill out this review form, although nothing has changed significantly in my world other than a worsening perhaps that I can't find energy to document, the law has changed in a way that I think I should get the mobility award.
Does anyone think this is worth pursuing or is the fact that even writing this note for the forum has taken all today's energy mean that it's better just to take what I am lucky enough to receive (and that largely thanks to the excellent guides I have studied here).
With thanks
Kathy

Nothing on this board constitutes legal advice - always consult a professional about specific problems

If you think that you meet the criteria for a Mobility award then you should certainly consider arguing for it but make sure that you actually understand the criteria you are being asked to meet, this is the area that we receive the most questions about and which is clearly the least understood by members.
