Esa am I on the wrong element was created by Newbie100
Hello

Can I ask a question - I get 110 contributions esa and 70 income related I’ve always been the support group - I also get the PIPS enhanced rated disability
When I was on years ago the old INcapacity benefit
Before I went into the ESA support group
So my question is
Should my element of ESA be all contribution rate and not part income related ?

As il me buying a house soon with my partner I’m aware I will lose the income related amount but keep the contributions rate but shouldn’t it be all contributions
I have a letter from the DWP which states 110 contributions and 70 income related

The reason why I’m bringing this up I saw a post on Yourable

Transfers from Incapacity Benefit. (Also see the note at the bottom).
If you were transferred to ESA from Incapacity Benefit then your ESA started as Contribution Based.
If you transferred from IB to Support Group then it remains Contribution Based for as long as you are in Support Group.

Legacy ESA as it is now called, is a single benefit with two eligibility options, one is based on the claimant's Contribution History and the other on their household income, savings and assets and any hours that a partner works.

So claimants transferred from Incapacity Benefit are considered to have already met the Contributions Conditions for ESA and therefore receive ESA(CB) but if their household has a low income and savings then they can also be entitled to what is called an Income Related ESA top-up, so they receive both ESA(CB) and ESA(IR).

You are one of these people.

I don't know your circumstances but buying a house will not normally prevent you continuing to receiving ESA(IR) but if you do lose it then you would still be entitled to you ESA(CB).
