The dreaded brown envelope has arrived. I have been granted a standard rate for daily living needs, but have not been awarded PIP for help with mobility. Moneywise it works out at £5 a month less than my DLA was. in their decision re-mobility they are making light of things that I have said and almost twisting them around to make it sound as though I’m out and about all the time and that couldn’t be further than the case. Would I be silly to ask them to reconsider the mobility decision.
I have been told by my local authority I can continue using my blue badge until it expires in 2021, but will I now have to pay car tax.
Should I wait until next year and apply for them mobility component again and just let things lie at the moment. It is not about the money, it is just very unfair that they seem to be making light of my problem.
I apologise for the length of this post, but any advice would be gratefully received.

Hi Rosie
We cannot tell you if you should apply for a Mandatory Reconsideration (MR).
You need to get a copy of the assessors report and go through it carefully highlighting anything you disagree with and then use our Members Only Guides www.benefitsandwork.co.uk/help-for-claimants/pip, if you believe that you should have been awarded higher for mobility then apply for a MR and point out why you believe they have got the decision wrong. You have to make your case, if you have additional supporting evidence send it in.
Remember time limits to request a MR, one month from the decision letter date, if they still do not change the decision then appeal, but you run the risk of loosing what you have already been awarded.

thank you for your help. Do I stand a chance of losing the money I have been awarded at the MR stage or is it safe. is it at the appeal stage that you may lose what you have already been awarded. Also is it the

When you ask for a mandatory decision - they will always look at the entire award - so yes there is always a risk that your care award could be downgraded. Only you know whether you want to take the risk - plenty of people do. You need to weigh up if you think you have a good chance of changing the DWP's mind and where you might need to give more explanation, and where you can refute what the assessor said.
