I will not be making a claim for universal credit. I just have one more question does it help to attend an appeal in person or would it not make any difference if I decided to just appeal without attending? Thanks for all the help Gordon

Nothing on this board constitutes legal advice - always consult a professional about specific problems

Hi Sphere
You have a greater chance of winning your appeal if you attend in person and argue your case directly to a panel, but plenty of people opt for a paper-based appeal.

I wanted to provide an update and say thanks for encouraging me and helping me to file an appeal. I have good news the DWP reversed there decision without the appeal going ahead. My ESA has been restarted.
I just have one question it is in regards to the amount I receive £87.10 a week is this the correct rate? I will give a breakdown of the letter.
Living expense for you and your partner £114.85
Extra Money because your partner is a carer £36.85
Which gives a total income related amount £151.70
Income and Benefits
Carer's Allowance for your partner £64.60
Your Total Income £64.60
Your income related amount is £151.70 less total income of £64.60
So your income related amount is £87.10
I was in receipt of the disability premium when I used to receive incapacity benefit but for some reason I do not get it with my ESA, how do I receive that component any help would be appreciated. Thanks again for all the help.

Congratulations on getting the Decision revised by the DWP.
From your posts, this was in regard to a Failure to Attend Decision, that being overturned you should be placed back onto the Assessment Rate while a new face to face is arranged. The figures you include in your post appear to be correct but you can put your information into one of the online benefit calculators to check if you should be receiving any additional money.
