If you are unable to stand and move more than 1 metre but no more than 20 metres aided or unaided before 2pm on the majority of days due to chronic and complex conditions should you be counted as not being able to walk as cannot walk when it is normal for a non disabled person would? Thanks
Possibly and I would certainly argue that this is the case.
My uncertainty is because there is a UTT Decision on this subject for Daily Living but it does not specifically state that it covers Mobility.
The Decision requires there to be context as to whether the limitation applies for the whole day.
So as an example; someone who due to pain is unable to wash and bathe in the morning until their pain relief kicks in several hours later would be considered as being limited for this activity for the whole day as it is reasonable for it to be done at the start of the day, but the same argument would not hold for preparing and cooking a meal as this could be done once their pain killers have had effect.
