I have looked at the guides how to best to set out your MD . It says the assessors said you walked and would be able to walk .But I was not asked to walk he said I told him I could catch a taxi and walk and it would take me 40 seconds and would be able to to walk again he gave me standard . That was not said it tells you not to express to much about the lies , my walking has not suddenly improved I wrote in my form about falling and get stressed in case I fall and not able to get up which as happened . How shall I word it and not mention what he put was not true thank you for any advice

Hi Peg

What the guide tries to say - is that there is no point in calling an assessor 'a liar' and to try and challenge the 'lies' with evidence.

So you could say eg" The assessor says that I can catch a taxi and walk for 200m repeatedly and reliable. However, the assessor is mistaken. I never catch a taxi and I am only able to walk for 50 meters. Even when I walk that distance, I have to stop several time because of shortness of breath - due to the chronic pain I suffer and as noted in letter from DR P Paul (13/2/2018).... etc etc

This is only an example - with made-up text. I have said that the assessor is mistaken and counteracted it with evidence.

Hi, Peg,

Bis is right. I made that mistake in the past and it got me nowhere. Finally, I saw sense in my last PIP MR last year.

I challenged the nurse's qualifications. She didn't have relevant experience in mental health issues otherwise she wouldn't have wrote ridiculous things about the heavy medication I was, and am currently prescribed.

She didn't really understand what any of my MH medication was for, she just dismissed all the meds and said my medication was keeping me stable, which I can assure you it wasn't and still is not.

I wrote something like 'the nurse was not suitably qualified to judge my mental health status or comment on the medication I am taking, therefore she misled the Decision Maker into making the wrong decision'.

Having read the guides really carefully and modelling my MR on these, I did get my old award reinstated.

Good luck,

Phrank.

Just like to thank Benefits and work . I asked for a mandatory reconsideration on the 05/11/19 As I had been awarded standard mobility , I explained the assessor was mistaken about how far I could walk . I did not dwell on his wrong information . I sent a photo of my leg which is badly bent and explained about the pain I have when walking. To day 28/11/19 I have had the dreaded brown envelope to say they have given me The enhanced rate of mobility . I was concerned that I may lose the lot , but the lies made me go ahead to do the MD thank you for your advice
