At what point do you give up? was created by Maxi66
A genuine question as I have now been asked to attend for another assessment for ESA. This is despite medical evidence covering some ninety operations in plastic surgery, gastrointestinal problems, heart problems, osteoarthritis problems etc.
I get ESA and PIP and I am also curious why do the DWP not have access to your CHI or NHS number thus enabling them to look up and see exactly what is going on. It defies belief that despite everything that they have been furnished with that they still ask me in for assessment.
So my questions is as above, at what point do you give up? as I really feel I do not have the strength to go through yet another assessment, mentally or physically.

I don't have an answer for you! The view of the Government is that claimants should be regularly assessed to see if they continue to meet the criteria for the benefit they are receiving.
The DWP does not have access to your medical information because it is a data protection issue.

Gordon,
Does a claimant have the authority to give the DWP access to their med records, hence no data protection barrier, hence the DWP can save the costs of re-assessments, hence save the claimant unlimited stress as a result, and in many unfortunate cases cut down the suicide numbers.

By including your medical contacts on the assessment forms you are giving the DWP and its agents access to your medical information via the contact but this, of course, assumes that they will be contacted and the sad situation that we all face is that they do not request the information from those contacts for the vast majority of claimants.

I NEVER give up Maxi - at least not permanently - and that's my genuine answer to your genuine question! Many of us on here have been through the mill like you, and sometimes more than once, and we're all of course struggling with our own health problems too, but I'm afraid if we're turned down for benefits, or levels of benefits, that we believe we're entitled to it's highly unlikely that this will change unless we find a way to challenge it, hopefully with help eg from this site. The stark reality is that if you 'ask' you might get but if you don't ask it's extreme unlikely you will! I'm not unsympathetic, it can be hard and even seem impossible at times , I''ve felt like that myself, but it can be very rewarding, - if you pardon the pun - when things change for the better and you feel that justice has eventually been done in your case!

Thanks folks for the replies, yesterday was a really bad day. In particular because my wife reminded me that when we went three years ago the assessor said "i cannot believe you are here" and when I questioned her on the comment it turned out some GP's are leaving blank a paricular question on the form that they are sent. When I asked the surgery about this they said it was because the question was put in such a way that the DWP were putting the onus on the GP to say whether you were fit for work or not and in their opinion that was not their job. So hopefully like last time it will be a quick in and out.
