I have been on DLA since 1995 for life!! middle care and high outside I have had a motability car since 1995. I have been awarded Standard on both for PIP!!! I need you to help me please to get my Enhanced for outside. I had the decision over the phone & letter with points results is in the post. I Also have a copy from assessment from 21/09/2019 She has lied and questions she has not asked me nor my husband who was with me on the day. Examining me she has said I can put my arms around the back of my neck. I didn't do this & was not asked to. Plus I can't do this. Can you help me please. Plus her written English language is awful. But she spoke perfectly. I have been given 9 points for care & 10 points for outside. I need to appeal once I get this in written form from DWP Help please. I am a member with you.

You say that you scored for the "outside" could you explain what you mean, did you score the Moving Around activity, Going out or a combination of the two?

Did you expect to score higher for the Daily Living component?

The first stage to challenging a Decision is for you to request a Mandatory Reconsideration, this needs to be done in writing to the DWP, within one month of the Decision, to the office that dealt with your claim, have a look at our PIP MR & Appeal guide for details of the process, the PIP area also has template letters that you can use to make the request with.

www.benefitsandwork.co.uk/help-for-claimants/pip

You should contact the DWP for a copy of the assessment report if you have not already done so, I would phone them but again follow up the request in writing. Once you have the assessment report you will have a better understanding of how the DWP Decision Maker has come to their conclusions and will then be able to argue against them.

Your primary task is to show that you meet the criteria, there are many reasons you may have failed, you need to address each of these but don't get bogged down in criticising the assessment report unless you can clearly show that it is incorrect, it is a lot easier to argue the facts of the situation;

"the assessor recorded that I walked 50m, I did but they have failed to document that I had to stop every 10m for a rest due to breathlessness"

than their opinions

"based on my observations of the claimant walking I believe that they can reliably walk more than 200m.

When you have a better idea of the issues with your claim, come back to the forum and we will do our best to help.

Hi Gordon, it was given to me verbally on the phone by DWP standard for both daily living and moving around 9 points & going out the same standard 10 points.. I expected to score higher for outside. I do have the assessment report. But still have not had the dwp decision letter it was all on the telephone when chasing it up as they said it was posted out to me and then it turned out it was sent last Thursday so 7 days ago today. The person I spoke with said to me that as soon as I recieve the decision in writing to call back and make a Mandatory Consideration once I know how the points were given to me. I do not understand the question How do I plan a route on going out I thought it was about the motability car so I answered Sat Nav. I did say I can walk between 20m to 50m I did not say on the form about stopping every 5 minutes on the dwp forms but I did say this to the person taking the face to face assessment. Thank you for answering me and I understand I can not do nothing until this letter of decision arrives in the post. Many Thanks

If you scored eight points for Moving Around (you can't score nine!) and ten points for Going Out then the total of 18 points would mean an Enhanced award not a Standard one.

You will have to wait for the Decision Letter to see what has actually been awarded.
