Hi there I’ve asked permission to appeal to the upper tribunal which has been refused by a District Judge. It goes on to say that if I want too continue with the application I could apply directly to the Upper Tribunal using the form (UT1) Time is running out and I still feel strongly they have not given the correct award. Is it worth it I wonder!
The only way a case will be heard by the Upper Tribunal is if you can show there has been an error in the way the law has been applied to your claim when the First Tier Tribunal made their decision. It isn't enough just to disagree with the decision. Only you know whether you have suitable evidence to prove this and you may need to find examples of case law that has already set a precedent or if your case is the first of its kind show exactly where the panel erred. You may need some legal advice going forward.
