Hi
I received an ESA85 report 8 pages after my face to face last week,
I claimed for the first time July this year so this was my first face to face
It’s a little confusing
[LCW and LCWRA information)
There’s a paragraph under this title
But it also says
The client was found to meet the criteria for limited capability for work and work related activity
(what does this mean)
At the end it says
The available evidence suggests to review in the medium term
Any help would be appreciated
Many thanks

Nothing on this board constitutes legal advice - always consult a professional about specific problems

Hi Rozm2004
It means that you meet the criteria for the support group and you will not be reassessed for 1-3 years, it could even be longer.

Hi
Wow thanks for your reply that’s what I’m hoping for just need the dwp to agree to it ......fingers crossed
Also I have another problem, I receive an ill health pension from nhs which is £540 per month and gave dwp all the details in July which they have sat on until I called them the other day and they now are deducting £20 per week taking my benefit to £52 per week,
The problem I have is I am now being taxed on my pension so only getting £460 per month .........have called them and they called me back friday but I missed the call......does this seem right? And if I do go into the support group will I receive the extra money or will it be deducted because of my pension ?
Sorry for all the questions only it’s been a mine field as I’ve never claimed anything before
Also one more thing (I promise ha ha ) I have submitted my appeal for PIP following all the help on here and they have until 23rd December to respond which I doubt anything will change but would they have access to the medical report from ESA HP ?
Thanks

Hi Rozm2004
Once you get put in the support group you will get an additional premium £38.55 pw added to your basic ESA , it will not be deducted because of your pension, as you have already had deductions. Remember that any income you have from pensions is taken into account when working out your ESA. What we do not know is what type of ESA you will receive IB or IR, I would therefore suggest that you seek face to face advice from a Welfare Rights organisation to check that you are receiving all your benefit entitlements.
In answer to your second question, DWP has access to all your records but you PIP medical assessment in independent from your ESA and the descriptors are different so your ESA medical assessment is not taken into account for PIP.
