  			 				Hello.
I was wondering if you could tell me if a parent claims dla and daughter claims pip.is she entitled to put a claim in for sdp.it's just when she was first awarded pip dwp contacted to say apply for sdp.but she couldn't get it because she lives in and only one parent was getting dla.but said if both were she would have been entitled to it..but since sadly her mam has passed away and only her dad and herself in the same house.so she was wondering to ring them up again.because dad still gets dla and she has pip.

I take it that her mother did not claim DLA or PIP? To be eligible to claim SDP her father would have to be in receipt of DLA care component at the middle rate or higher and the daughter in receipt of the daily living component of PIP. If anyone else lives in the home over the age of 18 and they are not in receipt of PIP or DLA then that will stop any eligibility.
 
If no one else lives in the home then first question to ask is does the daughter receive ESA (IR) if yes then she will eligible to claim SDP which should be backdate.
 
The father may also be eligible to claim SDP depending on his circumstances, I would seek advice from a local welfare rights unit or use an online calculator such as Turn2us, you can contact their helpline 0808 802 2000.

  			 				No her mam didn't claim.any dla or AA just her dad dla.and her dad does get middle rate and she gets high rate pip..and also inome related and dad state pension and pension credit.

I come across this situation quite frequently, the SPD if he is not getting it should also be backdated to date his wife died. They both should ask for an 'any time review' and not a backdate, a backdate usually only goes back one month, an anythime review goes back to the beginning.

  			 				My friend contacted about sdp but they don't think she will be entitled to it when checking her dad dla he has only low rate care.but said if she lived on own she could apply.which she was thinking about moving out on her own preview sly. ..so if she did would this trigger universal credit.or claim sdp first before housing benefit..
