Hi
I get ESA with the disability premium but I was told by
ESA yesterday that when my child who is 20 comes home during holidays from university i won’t be able to get the premium.
But I read online if the child pays towards rent I can get the premium
My child pays £50 towards the rent I don’t get housing benefit because my rent is only £100 a month
So I never applied for housing benefit
Could I still get The ESA disability premium

I'm afraid it is not that easy, this is all about you living alone of being considered as living alone.
A non-dependant who pays their own rent to a landlord and has separate living arrangements from the claimant should allow payment of the SD Premium as they would be considered as living alone but your child paying rent to you will not count.
The only way that you may be able to retain the Premium is if they can show that they are permanently resident at another address and are therefore only visiting you over the holidays, student halls of residence will not count as they are defined as temporary.

Forgive me but why would a landlord provide a tenancy for someone who is only living in the property during college holidays.
Why not ask the child to make up the lost benefit?
