The situation is... Employee signed off sick long term, SSP has ended but employment continues, unsure of how long, currently been off sick since October 2018. Enquirer has partner on a 'good income'. Can enquirer claim ESA and will it be contribution based?

They can make a claim for New Style ESA not ESA if they have a minimum of 50 weeks NI Contributions in the both of the Tax Years 2016-17 and 2017-18, the Tax Years will move forward a year on Monday 6 January 2020.
