Hi there, I have had my ESA stopped as I went over the allowance for the amount of money I can get from PERMITTED WORK. It was a very brutal letter. Say that I am being treated as not having limited capability to work.
I mess up...any advice?
Does going over the allowance mean I have the capability to work? my circumstances have not changed and I staid under the hours. Should it not be a situation that they might have just overpaid me? and I repay?
If you are then the earnings limit is a fixed line, if you exceed the limit then you are considered to be in remunerative work and no longer have Limited Capability for Work.
Is there any debate to be had about what you have earned? Is there any way that you can argue that the amount were incorrect? Was it a one-off or did you exceed the limit for a period of time?
