Hi. I am currently on ESA Contribution based as I am still living in my ex husband's house. I have found another property to live but have been told to transfer to ESA income based. I have had advice from CAB . On the ESA form one of the questions asked is whether you have a carer who looks after you and the CAB are advising me to tick no. I do need help but obviously won't have this straight away. This doesn't make sense to me as if I say that I do not need a carer then won't that effect the ESA and DLA that I receive. The CAB then want to add severe disability premium and enhanced premium to the ESA when income based which will then let me apply for housing benefit and council tax. They have looked into it and I don't need to transfer to Universal Credit. I overthink things a lot so if someone on here who knows about this could tell me whether I need to say yes or no to this question on the ESA form of whether I have/or need a carer. Also whether this will set off a problem with the DLA as I get middle rate care and lower rate mobility Many thanks in advance.

I am guessing from your post that you are in the support group of ESA and high care for DLA.
The advice you are receiving from Citizen Advice is correct, when you move into your new property on your own and no one claims carers allowance for looking after you, you will be eligible to claim SDP and EDP with your ESA.
You cannot claim SDP if you only get contribution based ESA. You can claim both contribution based and IR ESA, to get SDP you have to claim IR ESA, to get this premium, this would depend on your circumstances.
If you claim contribution based ESA and you are in the support group then there are no time limits and household income is not taken into account, your claim will stay in payment until you are reassessed. If you were in receipt of contribution ESA but placed in the WR group then your claim would only last one year before you then have to apply for IR ESA, this benefit would depend on your household income.

Hi. Thank you for your response. I am in the support group for ESA but the middle rate for care for DLA and the lower rate for mobility. On my DLA form I stated that my husband was helping with me for both care and mobility. I just got a bit confused as if you're receiving help with looking after yourself and you then become single and I would live only with my 9 year old how you could claim benefits for care and mobility. There are many paid caring companies where I live and I have enquired about help from them. The ESA (IB) just said do you need care with looking after yourself and everyone is telling me to tick no when I actually do need it and wouldn't this conflict with the DLA as if I was awarded it as I need help with care and mobility when living alone there would be no one there to help with care needs. I just thought the powers that be would start sending me new assessment forms for DLA/PIP. I have also made a part enquiry into adult social care in terms of if I could receive help from them. Thanks for your patience.

Providing you are receiving what is now called legacy ESA and not New Style ESA, then having Income Based ESA to your claim only requires a financial reassessment, it does not look at your care needs. You will be asked to complete an ESA3 see

If care is provided by your Local Authority or you pay for care yourself, then it will have no effect on your ESA but if someone claims Carers Allowance against your DLA award then you would lose £65/week from your payments, assuming that you are entitled to the extra money in the first place.
