Just wanted to say thank you to benefitsandwork.for the guides and advice for the PIP application, assessment and appeal process - This is my story of my PIP success
I Reached 65 in July and after 12 years on DLA mid rate daily living & high rate mobility ( indefinite award ) I had the dreaded PIP assessment lasting 2 hours at my home in August, with my wife (my full time carer) and my son (a 5th year medical student) in attendance , the assessor agreed they could be present and help me with the assessment as my health is not so good. The assessor was very friendly and sympathetic and said she was impressed by the support letter from my GP all the supporting medical evidence and my application form. I was feeling positive about the assessment but after waiting 6 weeks for the result I found I had been awarded 11 points for daily living but only 4 points for mobility with resssessment in 12 months.
I was really upset and very disappointed about the mobility assessment and requested a copy of the assessors report. When it arrived I could not believe the number of contradictions, untruths ( lies to be accurate ) and the unbelievable way she had filled in the assessment form, copying and pasting the same comment to every section, this comment contradicted her observations in the first pages of her assessment..Her scores for each section did not compare with her own written comments / observations at the start of the assessment report, nor the medical reports she had said had impressed her. We just could not believe how she could have lied so much, nor the fact that the DWP just used all her scores and also her reasoning she gave for making the scores so low when determining the outcome of my PIP application, and the fact they had not really made any detailed considerations themselves. One comment from her and repeated by the DWP that she had observed me pushing myself back into my chair meant my legs were strong and she estimated from this I would be able to walk unaided more than 200 meters really upset me and my family, what a ridiculous way to assess mobility.
By accident the assessment was recorded on a security camera my family have installed to check I am ok if they have to leave me alone at home - fortunately my son had left it recording. After watching the recording of the assessment ( camera was on on myself ) and reading some of her observations and comments about things that were said it was obvious she had made things up and also lied about my mobility, general health, demeanour , how I was unable to answer her questions and required help from my wife and son. I sat the whole time, became distressed a number of times, was unable to carry out some simple movements without severe pain, she asked me to do near the end of the assessment - she actually stopped these tests herself and ended the assessment saying she was satisfied she had enough to complete her report.
After watching the recording I felt confident enough to be able to challenge her assessment report. Advice is given not to say the assessor has lied for appeals as it could work in a negative way, but I was so incensed I did not hold back, and I challenged every comment she made that was misleading / untrue. After discussing with CAB and reading the mandatory reconsideration guides from benefitsandwork I submitted my M R form with detailed accompanying notes,
14 weeks later I received the decision, I had been upgraded to high rate for both, scoring 14 points for daily living and 12 points for mobility with reassessment in 2029. I only wish the DWP had actually read the medical reports and application form when making their original decision instead of relying solely on the assessor report.
I would advise anyone that is not happy with their assessment to persevere and use the guides from Benefitsandwork to challenge the assessment reports for the mandatory reconsideration, and or for the appeal if MR is unsuccessful.
