If a person is on ESA income based and in the support group aswell as PIP with the severe disability element, can the DWP reacess the severe disability element prior to the overall reassessment for ESA? I won my appeal in August 2018 and the judge recommended that I should not be reaccessed until August 2020 for the ESA. Documentation afterwards from the DWP stated I could be entitled to the severe disability premium of which was subsequently awarded. MY PIP letter states my claim is until Jan 2021. Thanks in advance
If I understand your question you are asking about the Severe Disability Premium, this is not an assessed benefit it is paid because you meet certain criteria;
- you have a qualifying award of PIP Daily Living - you live alone or are considered to be living alone - no one claims Carers Allowance against your PIP award
As long as you continue to meet these criteria and you have an award of ESA that includes the Income Related element the Premium is payable.
