I am supporting a woman who recently had her PIP award changed to Enhanced for Daily Living and no award for mobility.
She has significant mobility issues, and I am confident she is entitled to an award for these.
She recently started a part time job and is in receipt of Working Tax Credit. As you can only receive WTC (as a new claimant) by also being in receipt of ENHANCED PIP award, we need to ensure we do not jeopardise this by asking the DWP for a Mandatory Reconsideration of her PIP award.
Can anyone clarify for me if the DWP can lower an award at Mandatory Reconsideration stage? Ie is there a risk if we write the MR letter that she will lose the Enhanced rate already awarded for Daily Living needs?
When a claimant puts in for a mandatory reconsideration the whole award is looked at, not just part of it - so yes, there is a risk that the enhanced part of the award could be downgraded. It doesn't often happen, but it has happened to some people.
