Hi was just wondering if you could help me,I lodged an appeal for my 21 yr old son on the 24th October,I had a text message to say dep has responded but to date I still haven’t receive the appeal bundle,and today I have receive another text to say appeal is booked for 21st January,I am his appointee and I have asked for a paper based hearing,just wondering what I do as I have no appeal bundle?kind regards

You need to contact the Tribunal Service as a matter of urgency, the DWP should have sent you a copy of their submission to you directly.

Did you chase anybody when you received the text in October?

You need to insist on the hearing being delayed so you have the month allowed to respond to the DWP's submission.

The dwp were meant to respond by the 28th November but they didn’t.tribunal service sent a direction notice to them ,I contacted pip and they said it was with the appeal writers who were waiting for the ssc1 form.this was yesterday.

You should not be speaking to the DWP about your appeal unless they are offering a revised Decision, all of you communication needs to go through the Tribunal Service.

You need to contact the TS, you are entitled to one month's preparation after you have received the DWP's submission before the hearing takes place, unless the TS have decided to proceed without it.

Thankyou for replying,I have spoken to the tribunal service and they said the judge has decided to go ahead with out the dwp response,is this a good or bad thing,I am so confused also I didn’t think it would be that quick.

OK, then any testimony and evidence that you want the panel to consider need to be with the DWP noo later than 14 January or you risk it being excluded.

As the DWP has made not made a submission you also need to think about what information you need to supply in addition to the above, for example would it help if they had a copy of your claim form and the information that you attached to it.
