Thank you Gordon. I wonder what a person would do if they had been considered to have deprived themselves of capital & yet they had no money to live on ? As I think I have picked up from previous posts, is it the best course of action to gain authorisation in advance from the DWP. ? Is there a particular format that the letter should take ?(& where should it be addressed?) Should evidence be included etc? I have read that monies available can be disregarded for the first 26 weeks if they are solely intended for the purchase of a property but I think this may not apply to someone moving from rented accommodation? Thank you for your help.
The DWP is often reluctant to make a decision (non binding) before they have to make a Decision (binding) but with some persistence, you may be able to get them to do so.
Contact the DWP office dealing with your claim in writing, I would recommend you using a Tracked post so you have proof of delivery,.
The 26 week disregard only applies where the claimant has sold their home and there is a delay in purchasing a new home.
