Hello Advisers
You have helped me before regarding my DLA to PIP claim. This is ongoing but I am optimistic that with your help I will continue to get what I am entitled to.
Sadly for me ( you said it happens all the time ) I am also being dragged thru a second Universal Credit health assessment at the same time. My assessment is next week.
At my last assessment following the Man Rec and an appeal it was decided that I had limited capacity for work and for work related activity. The Court decided LCWRA after reading my Consultants letter, but now 2 years later here we go again, I am being dragged thru it all again.
So my questions are
Who decides if a person also has LWCRA when the assessor has awarded enough points for LCW.
How do they decide this? What evidence do they look at and from where.
What can I do to to ask for LCWRA again. Who do I ask

You can't make a request to be put in the LCWRA - you can only show by the information you provide that is where you need to be and show that your position is the same as it was when you won your appeal or perhaps got worse as you fill out the form. Include a copy of the judgement when you won..
You can read about how they are supposed to assess you from the handbook - It is very large. The information I think you want starts from page 67. Scroll down the page to DWP ESA resources and click on the link for WCA handbook

So are you saying that the decision maker at the DWP considers LCWRA in every case?
ATOS are no help as they always tick the review in 2 years box despite saying on the form that my condition will never get better, there is no cure, that they accept there will be a decline ( their words)
So who and at what time does the DWP decide LCWRA?
Should I present a copy of the Court order saying this at the assessment next week??

You want answers about the inner workings of the DWP that we do not have knowledge of. I can only refer you back to the booklet which is as much information as we have.
Yes, you can always show the tribunal decision at the assessment.
