Just a quick one, i understand that if DWP do not accept your reasons for a late MR and thus refuse an MR, you can go straight to appeal. Could you go straight to appeal AFTER the thirteen months?

Do you think after Mind going to the Supreme Court for a claimant regarding mental health and
the prompting element of mixing with others, ie the descriptor being unclear and many mh claimants missing out on awards as being classed under the prompting (being underscored) - could this lead to the DWP having to relook at previous claims for unfair scoring?

Hi Cruella

That has been no word that the DWP is going to examine back cases since this ruling. Most people have assumed that it will have an impact on those applying in the future. That is not to say they won't look at anything retrospectively - they just haven't announced they are.
