I was wondering if anyone had an advice for my mandatory reconsideration. I had 11 points daily living from 2017 but when it was stopped in 2019 with null points.
The gist is that in my "mental state examination" in 2017 I looked unwell, was shaking etc but in my most recent one I seemed okay and was supposedly making eye contact so apparently I can manage face-to-face engagement etc. I didn't feel fine...
There are a lot of horrible factual inaccuracies and misleading statements in the report which I can correct but I'm not sure what to do about me seeming better which according to DWP is the main reason it stopped!
I have made some improvements to my health but unfortunately actually normal social situations are worse and I still meet the criteria. Is there anything I can say about the MSE comments?

If they think you are better what evidence do you have to refute this? Do you have a letter from any medical professional? If you take any medication has there been a reduction at all?
The problems with social situations - have you been clear how these affect you and how you meet the criteria? Have you got anyone who can write a letter in support of you - friend or family who can speak of the difficulties you have in such situations?
As far as what the assessor thought they saw at the assessment - I would always argue that mental health difficulties do not always manifest themselves in a person's outward appearance and that a complete stranger who only saw you for an hour perhaps an hour and a half can not accurately judge how you were feeling. (Then describe your experience).
Whatever you say your greatest focus should be on the areas where you didn't score points and think you should have done so.

Thanks for this. I am just finishing off my MR request. I have some more evidence but it is quite vague as though I gave the descriptors they said they didn't know whether I could manage some of them or not or how often. I dont have any friends and family to ask but am completing a diary. Is there anything else that might help please?
I was actually wondering if I should make a complaint about my assessor. I have a diagnosis of anorexia and they have noted that I have not "told them that I am losing weight" and guessed that I was "average build". That's actually quite a dangerous thing to tell someone with my condition and at any rate even the experts can't tell this.

I think you have done or are doing everything you can do.
It is up to you whether you decide to make a complaint about the assessor. This is handled separately from your claim.
